Calculated Risk Winery reserves the right to update or modify these Terms and Conditions at any time, with or without notice. Continued use of the Site following any changes constitutes acceptance of those updates.

We also reserve the right to modify or discontinue any part of the Site, including content, offerings, and functionality, at any time.

Eligibility

This Site is intended for individuals who are 21 years of age or older. By using this Site, you confirm that you are at least 21 years old.

User and Account Responsibilities

Certain areas of the Site may require account registration. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

Calculated Risk Winery is not responsible for any loss or damage resulting from unauthorized use of your account. You must notify us immediately if you suspect any breach of security.

We reserve the right to refuse service, terminate accounts, remove content, or cancel orders at our discretion.

Use of the Site

You agree to use the Site only for lawful purposes and in compliance with all applicable laws.

You may not:

  • Violate any laws or regulations
  • Interfere with the Site’s functionality or security
  • Use bots, scraping tools, or automated systems
  • Upload harmful code or attempt unauthorized access

Legal Compliance & Shipping Restrictions

By placing an order, you confirm that:

  • You are at least 21 years old
  • The recipient is at least 21 years old
  • You are purchasing wine for personal use, not resale

Alcohol shipments are regulated at the state level. We only ship to states where permitted by law. Orders placed for restricted states will be canceled and refunded.

Adult Signature Requirement

All wine shipments require an adult (21+) signature upon delivery. Carriers will not leave packages unattended.

It is your responsibility to ensure someone of legal drinking age is available to receive the shipment.

Shipping Risk & Responsibility

Title and ownership of wine pass to the buyer at the time of shipment.

Calculated Risk Winery is not responsible for:

  • Failed delivery attempts
  • Delays caused by carriers
  • Packages returned due to unsuccessful delivery

Additional shipping fees may apply for reshipment.

Weather & Temperature Policy

Wine is a perishable product and can be damaged by extreme heat or cold.

We may:

  • Hold shipments during extreme weather conditions
  • Recommend delayed shipping for product safety

If you request shipment during extreme weather, Calculated Risk Winery is not responsible for damage caused by temperature conditions.

Returns & Damaged Goods

Due to the nature of wine, all sales are generally final.

We will replace or refund on a case by case basis:

  • Bottles damaged in transit
  • Defective products (e.g., corked wine)

You must notify us within a reasonable timeframe after delivery and provide photos of damage when applicable.

We do not accept returns based on taste preference. If you purchased from a third party, you need to speak with them directly. We do not give refunds for third party purchases. 

Order Accuracy

It is your responsibility to ensure all order details (including shipping address and contact information) are accurate at checkout.

Calculated Risk Winery is not responsible for delays or losses due to incorrect information.

Pricing & Availability

All prices are subject to change without notice.

We reserve the right to:

  • Correct pricing errors
  • Limit quantities
  • Cancel orders due to inventory issues

If an order is canceled, you will be notified and refunded.

Promotions & Discounts

Promotions, discounts, and offers:

  • May be modified or discontinued at any time
  • Cannot be combined unless explicitly stated
  • May have eligibility requirements

Wine Club Terms (if applicable)

By joining a Calculated Risk Winery wine club, you agree to:

  • Recurring shipments and charges based on your selected club
  • Automatic billing prior to shipment
  • Updating your account information as needed

Cancellations must be made prior to the billing date. Once an order is processed, it cannot be canceled.

Additional terms may apply and will be outlined at the time of signup.

Governing Law

This Site is operated by Calculated Risk Winery in the State of California, USA. These Terms and Conditions are governed by the laws of the State of California and applicable United States federal law.
